The following terms of service govern your use of this website.

Acceptance of Terms: Welcome to the SureShot Books Publishing LLC’s website. By using this site, you accept these terms. In addition, you may register a SureShot Books Publishing LLC account only if you acknowledge your acceptance of these terms. These terms govern your use of the site. Additional terms and conditions of sale apply to your purchases. For instance, when sending books to inmates, we must also abide by the institution's rules. SureShot Books Publishing LLC reserves the right to change these terms from time to time. Please refer to this site periodically for any changes.

Modifications to Service

SureShot Books Publishing LLC reserves the right at any time and from time to time to modify or discontinue the availability of the site (or any part thereof), temporarily or permanently, with or without notice to you. You agree that SureShot Books Publishing LLC will not be liable to you for any modification, suspension or discontinuance of the availability of the site.

Termination of Service to You

You agree that SureShot Books Publishing LLC, in its sole discretion, may (as applicable) terminate your password, account (or any part thereof) or use of the site, and remove and discard any content within the site, for any reason, including, without limitation, our belief that you have violated or acted inconsistently with the letter or spirit of these terms. You agree that any termination of your access to the site under any provision of these terms may occur without prior notice to you, and you agree that SureShot Books Publishing LLC will not be liable to you for any termination of your access to the site.

Intellectual Property

All content of this site is the property of SureShot Books Publishing LLC or its content suppliers, and is protected by United States and international copyright laws. The compilation of the content on this site is the exclusive property of SureShot Books Publishing LLC, and is likewise protected by U.S. and international copyright laws. "SureShot Books" is a trademark of SureShot Books Publishing LLC and may not be used in connection with the products or services of others in any manner that is likely to cause confusion. All other trademarks not owned by SureShot Books Publishing LLC that appear on this site are the property of their respective owners.

Limited License to Use the Site

SureShot Books Publishing LLC grants you a limited license to access and use the site for its intended purposes. The only permitted commercial use of the site is for buying books for commercial use or resale. You agree not to access or use the site for any other commercial purpose, including but not limited to copying the product listings, product descriptions, or prices, deriving account information for the benefit of another merchant, and extracting data from the site using robots or similar automated data gathering and extraction tools.

No Use of the Site for Prohibited Content

You agree not to use the site to transmit any content that is:

(1) Unlawful under the laws of any jurisdiction to which you or SureShot Books Publishing LLC are subject.

(2) Harmful, threatening, harassing, defamatory, invasive of the privacy of another, or obscene (including without limitation any images or depictions of child abuse, child pornography, or minors engaged in sexual conduct or explicitly sexual situations).

(3) Insider information or any other proprietary or confidential information.

(4) An infringement of any patent, trademark, trade secret, copyright or other intellectual property right.

(5) Falsified, including without limitation the use of forged headers or otherwise manipulated identifiers in order to disguise its origin.

(6) Containing or transmitting software viruses or any other malicious computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software. You agree to indemnify and hold harmless SureShot Books Publishing LLC from any liability incurred as the result of your violation of these terms.

Disclaimer of Warranties and Limitation of Liability

YOU AGREE THAT THE SITE IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SureShot Books Publishing LLC does not warrant that the site will be available at any given time, secure, or free of error. You use the site at your own risk, and you assume the risk that any material downloaded by you from the site may cause loss of data or damage to your computer system. YOU UNDERSTAND AND AGREE THAT IN NO EVENT WILL SURESHOT BOOKS PUBLISHING LLC BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES, EVEN IF SURESHOT BOOKS PUBLISHING LLC IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS OR FOR ANY OTHER SPECIAL, CONSEQUENTIAL, EXEMPLARY OR INCIDENTAL DAMAGES, HOWEVER CAUSED, WHETHER BASED UPON CONTRACT, NEGLIGENCE, STRICT LIABILITY IN TORT, WARRANTY, OR ANY OTHER LEGAL THEORY. THE PARTIES INTEND THAT THIS LIMITATION SHOULD APPLY EVEN IF IT CAUSES ANY WARRANTY TO FAIL OF ITS ESSENTIAL PURPOSE.

Choice of Law & Forum Selection

You agree that any claims under these terms will be subject to the laws of the State of New York and of the United States of America, and you hereby consent to jurisdiction and venue in the courts of the State of New York.

Severability & Waiver

The invalidity of any term or provision of these terms will not affect the validity of any other provision. Waiver by SureShot Books Publishing LLC of strict performances of any provision of these terms will not be a waiver of or prejudice SureShot Books Publishing LLC ‘s right to require strict performance of the same provision in the future or of any other provision of these terms.

Entire Agreement

These terms constitute the entire agreement between the parties as to their subject matter. SureShot Books Publishing LLC may modify these terms in its discretion. In the event of a conflict between these terms and the terms and conditions of sale, the terms and conditions of sale will be controlling, if a conflict will not be deemed to exist on a matter about which one set of terms is merely silent.

Purchase Terms and Conditions

The following terms and conditions of sale govern all purchases from SureShot Books Publishing LLC ("SureShot Books"). To the extent that these terms conflict with or differ from those contained in any purchase order or other procurement documents of Buyer, these terms will control. Buyer's acceptance of, or payment for the goods shall conclusively affirm Buyer's assent to these terms.

Delivery

SureShot Books Publishing LLC shall use its judgment to determine the most cost-effective packaging sufficient to protect the products in accordance with SureShot Books Publishing LLC’s Standard Shipping Policies. Title and risk of loss or damage pass upon tender of delivery of the product to the carrier. SureShot Books Publishing LLC will arrange for transportation and insurance at Buyer's expense, upon request by Buyer. The ship date is an estimate and is subject to change; customer agrees that time is not of the essence. Additionally, please note when sending books to prisoners or magazines for inmates that only USPS can typically be utilized. Any price that is stated or quoted includes only the products specified and is firm only for the period stated. Taxes shall be the responsibility of Buyer.

Acceptance of Orders

All orders are subject to acceptance by SureShot Books Publishing LLC at its place of business.

Force Majeure

SureShot Books Publishing LLC will not be responsible or liable for any loss, damage, or delay caused or occasioned by acts of God, transportation delays, accidents, fire, strike, civil or military authority, by the requirements of any statute, order or directive of any governmental authority, or by any other cause beyond SureShot Books Publishing LLC’s reasonable control. This includes institutional acceptance when you send books for inmates. Also, be aware that when you send magazines to an inmate in a foreign language, there can be a delay or rejection.

Inspection

Buyer shall promptly inspect the products upon receipt and shall notify SureShot Books Publishing LLC, and the carrier in writing of any nonconformity or defect within five (5) days following receipt by Buyer. All merchandise Buyer deems nonconforming must be maintained and stored in original shipping cartons until claim is resolved. In the event Buyer does not act within the time limit, Buyer agrees that it shall be conclusively presumed to have accepted the products and to have waived any defect discoverable upon reasonable inspection.

Warranty / Disclaimer

All products are warranted to conform to their specifications. SureShot Books Publishing LLC will replace, at its expense, any products that are found to be nonconforming, provided that Buyer gives written notice of the nonconformity within the warranty period. Buyer may be required to return nonconforming products to SureShot Books Publishing LLC at its facility in Nyack, New York, United States of America, or to the point of original shipment, whichever is specified by SureShot Books Publishing LLC authorized agent. SureShot Books Publishing LLC will ship replacement product to Buyer, freight prepaid, to any location in the continental United States. This warranty shall be void in case of mishandling or failure to maintain the product in accordance with SureShot Books Publishing LLC’s recommendations. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES OR OBLIGATIONS, EXPRESS OR IMPLIED. SureShot Books Publishing LLC EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL SureShot Books Publishing LLC BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, SUSTAINED FROM ANY CAUSE RELATING TO THE PRODUCT OR ARISING OUT OF ANY LEGAL THEORY, WHETHER CONTRACT, NEGLIGENCE OR STRICT TORT LIABILITY. BUYER'S EXCLUSIVE REMEDY FOR BREACH OF WARRANTY IS REPLACEMENT OR REFUND, AT SureShot Books Publishing LLC’s OPTION.

LIMITATION OF LIABILITY

IN NO EVENT SHALL SureShot Books Publishing LLC BE LIABLE TO BUYER FOR ANY CLAIM, WHETHER BASED UPON CONTRACT, NEGLIGENCE, STRICT TORT LIABILITY OR ANY OTHER LEGAL THEORY, ARISING OUT OF OR RELATING TO THE PRODUCTS SOLD, IN AN AMOUNT EXCEEDING THE PURCHASE PRICE OF THE SUBJECT PRODUCT. ANY LAWSUIT BY BUYER AGAINST SURESHOT BOOKS PUBLISHING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES, ARISING OUT OF OR RELATING TO THE SUBJECT PRODUCT, SHALL BE FILED WITHIN ONE YEAR FROM SHIPMENT OF THE SUBJECT PRODUCT BY SureShot Books Publishing LLC.

Applicable Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to the New York conflict of laws principles. The parties expressly disclaim the United Nations Convention on Contracts for the International Sale of Goods and this Agreement will not be governed by the provisions thereof. The parties agree that any claim asserted in any legal proceeding by one party against the other shall be commenced and maintained exclusively in state or federal court located within Rockland County, New York. Both parties hereby submit to the jurisdiction of such courts over each of them personally in connection with such litigation, and waive any objection to venue in such courts and any claim that such forum is an inconvenient forum. The prevailing party in any litigation arising out of or relating to this Agreement will be entitled to recover all reasonable attorney's fees and other expenses (in addition to statutory "costs" of litigation), including attorney's fees and expenses in connection with any trial, appeal, or petition for review.

Export Restrictions

Buyer at all times shall comply with United States laws and regulations governing export control. Buyer shall not use, lease, or sell any products purchased from SureShot Books Publishing LLC in any country, or to any purchaser or lessee in any country, other than the country of destination specified in Buyer's order, except in a manner expressly permitted by such laws and regulations.

Returns

Products may be returned to SureShot Books Publishing LLC only with SureShot Books Publishing LLC prior written authorization. Returns shall be subject to SureShot Books Publishing LLC’s return policies which SureShot Books Publishing LLC may change from time to time.

Precedence

These terms and conditions take precedence over buyer's additional or different terms and conditions. SureShot Books Publishing LLC agreement to sell products to Buyer, and any acceptance by Buyer, are specifically limited to these terms and conditions. In the absence of Buyer's signature on this agreement, Buyer shall be bound by all of these terms and conditions:

(a) Ten (10) days after Buyer receives these terms and conditions unless written notice of objection is given to SureShot Books Publishing LLC within the ten 10-day period;

(b) When Buyer issues any instructions to SureShot Books Publishing LLC and SureShot Books Publishing LLC makes a substantial beginning of commitments for their procurement; or

(c) With respect to any products for which payment has been made and accepted or which Buyer has received and accepted.

ENTIRE AGREEMENT

ENTIRE AGREEMENT THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN THE PARTIES WITH RESPECT TO THE SUBJECT PRODUCTS. ANY REPRESENTATIONS, PROMISES, WARRANTIES OR STATEMENTS THAT DIFFER IN ANY WAY FROM THE TERMS OF THIS AGREEMENT SHALL BE GIVEN NO FORCE OR EFFECT. ANY PROVISION OF ANY PURCHASE ORDER SUBMITTED BY BUYER THAT CONFLICTS WITH ANY OF THESE TERMS SHOULD NOT BE BINDING UPON SURESHOT BOOKS PUBLISHING LLC. THIS AGREEMENT MAY NOT BE MODIFIED EXCEPT IN WRITING SIGNED BY SureShot Books Publishing LLC.

SMS Terms & Conditions

SureShot Books Publishing LLC may send SMS text messages to customers who opt in through our website checkout, web forms, or by initiating communication with us. These messages are transactional and account-related and may include order confirmations, shipping updates, secure payment links, subscription reminders, balance alerts, and customer service responses.

Refund policy

SureShot Books – Refund & Correction Policy 

Effective Date: September 24, 2025

Overview

SureShot Books is committed to providing high-quality service to our customers and their loved ones in correctional facilities.
Because we process orders immediately upon payment, including verification, data entry, and non-refundable payment processing, we maintain a clear Refund & Correction Policy to ensure fairness to both customers and staff.

By completing your purchase, you acknowledge and agree to the terms below.

1. 24-48 Hour Correction Window

Customers have 48 hours from the time of purchase to request a cancellation.

Within these 48 hours, you may:

  • Request cancellation and receive a store credit for the full purchase amount 

Processing Fees

All transactions incur non-refundable payment processing fees charged by our provider (typically 3% + $0.30) 

2. After 48 Hours

Once an order passes 48 hours, it enters active processing, including title allocation, verification, and packing preparation. 

At this point, the order is considered final and non-refundable.

Cancellations requested after 48 hours will be handled as:   

         *  📦 Orders can be canceled within 48 hours of purchase.
          After that, a 20% processing & restocking fee will apply. 

         *  When an order is placed, our payment processor immediately charges a non-refundable 3% transaction fee.

For this reason, cancellations or refunds after processing begins are subject to this 3% processing fee.

This ensures fairness and allows us to maintain affordable pricing for all customers.

  • Store credit only 

  • No refunds can be issued unless approved by management - Example: Inmate has been released. PLEASE NOTE: THIS INFORMATION WILL BE VERIFIED OF INMATE RELEASE WITH THE FACILITY.

    Regarding books not accepted by the facility, NOT APPROVED VENDOR 
     REFUND IS ISSUED - MINUS SHIPPING FEES - AS WE MUST PAY USPS TO RECEIVE THE PACKAGE BACK.

Store credits never expire and can be used for any future purchase.

3. If a Refund Is Issued

In cases where management authorizes a refund to the original payment method (instead of store credit), the following fees apply:

  • Payment Processing Fee: 3.0% of total purchase + $0.30 (non-refundable by credit card provider)

  • Restocking & Handling Fee: 10% of total order value (covers staff time, verification, and reallocation of publications)

Total Deduction on Refunds: approximately 15%–20% of the order value.

This ensures the business can recover direct costs already incurred before shipment.

 

4. Explanation for Customers Who Decline Store Credit

At SureShot Books, we always recommend store credit because:

  • Store credit preserves your full purchase value.

  • Refunds always result in a deduction for fees already paid to banks and processors.

  • Our labor costs (verification, facility check, order prep) begin immediately after payment, even if the order has not shipped.

When customers demand a refund rather than credit, we process it as a loss to the company, since payment providers do not return the fees we paid when you placed the order.
For that reason, refunds are only issued in rare, approved cases and must include the processing fee (2.9% + $0.30) and 10% restocking/handling fee deduction.

We want to be transparent; these are not penalties. They are real costs that have already been paid on your transaction and cannot be recovered once the payment is processed.

5. SureShot Books Errors

If SureShot Books Publishing LLC makes a mistake (wrong title, duplicate order, incorrect shipment), we take full responsibility.

We will:

  • Issue a full store credit for the total amount or

  • Resend the correct item at no additional cost.

6. Inmate Transfers or Facility Changes

If your recipient has been transferred or is in transit, we can:

1. Forward the order to the new facility if publication has yet to ship, and all returns that have to be reshipped - the customer pays re-shipping fees. 
2. Provide a store credit equal to your full purchase value
3. Hold publications until the inmate arrives at the new facility

We do not issue refunds in these cases, as the order was properly processed and verified according to the information provided at checkout.

7. Non-Refundable Situations

Refunds or Credits will not be issued for:

  • Incorrect inmate / facility information was submitted by the customer.

  • Duplicate or accidental orders made by the customer.

  • Buyer’s remorse or changed circumstances.

  • Delays caused by USPS or the correctional mailroom.

  • Orders that are shipped as placed by the customer, even if the recipient is transferred or released.

8. Store Credit Details

  • Store credits are issued and can be redeemed on www.sureshotbooks.com website.

  • Credits never expire and can be used on any future purchase.

  • Lost or misplaced credit codes can be reissued upon request.

9. Chargebacks & Disputes

Filing a chargeback after accepting these terms may result in the forfeiture of store credit and suspension of future ordering privileges. Our support team is always available to resolve any issues quickly and fairly.

10. Request Process

To request a correction, cancellation, or refund:

IMPORTANT NOTE: All non-returnable books are noted in the book’s description. We will gladly reship your non-refundable book(s) to an alternate address of your choice. You must provide applicable shipping and handling rates for the number of books reshipped to an alternate address. If we do not hear from you within thirty (30) days, the books will be donated to charity.

IMPORTANT NOTES REGARDING NEWSPAPER SUBSCRIPTIONS:

ALL SALES ARE FINAL! NO REFUNDS, CREDITS, OR CANCELLATIONS. SureShot Books Publishing LLC cannot offer refunds, credits, or cancellations for newspaper subscription purchases. The reason for this is that our newspaper publishers do not allow for refunds, credits, or cancellations once an order is processed.

The newspaper subscription you purchased for your loved one is a MAIL subscription. It is not a daily delivery subscription. Therefore, your loved one will not receive newspapers every day nor every other day. Please allow 3-7 days per dated issue to be delivered to his/her correctional facility. Because it is a MAIL subscription, he/she can expect to receive their newspapers sporadically. This means that some days, he/she may not receive a newspaper, while other days he/she may receive more than one (1) issue.

All newspaper subscriptions are delivered by the USPS. Once a newspaper is mailed, it is the sole responsibility of the USPS to deliver the newspaper to his/her correctional facility. SureShot Books Publishing LLC has no control over when newspapers will be delivered to his/her facility by the USPS.

REASONS FOR DELIVERY DELAYS BY USPS: Reasons for delays in receiving his/her newspaper by the USPS may include the following: holidays, inclement weather, facility lockdowns, etc.

Once the newspaper is delivered to the correctional facility, it is up to the correctional facility to distribute the newspapers to your loved one. SureShot Books Publishing LLC has no control over when the facility distributes newspapers to inmates. For questions or concerns, please contact the facility’s Mail Room.

If your loved one has not received any issues of his/her newspaper within the first ten (10) days of the subscription start date, please contact us via email at info@sureshotbooks.com so that we can look into the subscription and resolve the issue.

Newspaper Publishers allow for a change of address ONLY. Please notify us as soon as possible if your loved one’s address changes so that we can update his/her information with the newspaper publisher. The correctional facility is responsible for forwarding all incoming mail, including newspapers, to his/her new address up to thirty (30) days of relocation. SureShot Books Publishing LLC is not responsible for any missing newspaper editions due to a change of address. 

IMPORTANT NOTES REGARDING MAGAZINE PURCHASES:

ALL SALES ARE FINAL! NO REFUNDS, CREDITS, OR CANCELLATIONS. SureShot Books Publishing LLC cannot offer refunds, credits, or cancellations for magazine subscriptions or single-shot magazine purchases. The reason for this is that our Clearing House does not allow for refunds, credits, or cancellations once an order is processed. Please be sure to check with the correctional facility’s guidelines prior to purchasing magazines, as some facilities allow for magazine subscriptions ONLY and do not allow single-issue magazines.

Magazine subscriptions ship directly from Publishers Clearing House. Some magazine subscriptions may take 6-12 weeks before the first issue is received. If your loved one has not received his/her first magazine subscription issue sixty (60) after purchase, then you should contact us. All “Single Shot” magazines ship directly from our New York headquarters. Please allow 7-14 days for delivery by the United States Postal Service.

Magazine Publishers allow for a change of address ONLY. Please notify us immediately if your loved one’s address changes so that our Clearing House can process this change of address. It is the responsibility of the correctional facility to forward all incoming mail, including newspapers and magazines, up to thirty (30) days after your loved one has been relocated to a new facility. SureShot Books Publishing LLC is not responsible for any missing magazine issues due to a change of address.

Magazine Publishers may cancel a subscription without notice. If this happens to your order, we will forward a similar product to substitute your original selection.
